Privacy Policy

1. Who We Are

Presently™ is a product of Ellite International Inc., a New York corporation operating at presently.legal. We provide AI-assisted voice intake services to solo and small-firm estate attorneys. References to "Presently," "we," "us," or "our" in this policy refer to Ellite International Inc.

2. Information We Collect

From attorneys (subscribers):

  • Name, firm name, email address, and phone number provided during account creation
  • Payment information processed by Stripe (we do not store card numbers)
  • Call configuration preferences and practice information

From callers (prospective clients calling an attorney's line):

  • Name, phone number, email address, and legal matter description provided during the AI intake call
  • Audio and transcript of the intake conversation
  • Date, time, and duration of the call

Automatically collected:

  • IP address and device information when accessing presently.legal
  • Usage data and interaction logs for service improvement

3. How We Use Your Information

We use collected information to:

  • Deliver the Presently service — answering calls, qualifying leads, and delivering transcripts to the subscribing attorney
  • Send email notifications to the attorney subscriber following each call
  • Process payments and manage attorney accounts
  • Improve the quality, accuracy, and performance of our AI voice system
  • Comply with applicable law and respond to lawful requests

AI training and corpus use: Call transcripts may be used in anonymized, aggregated form to improve our AI systems. Individual identifying information is stripped before any such use. Attorneys may opt out of corpus inclusion by contacting us at demo@presently.legal.

4. Call Recording and AI Disclosure

All calls handled by Presently are processed by an AI voice system and may be recorded and transcribed. Callers are informed at the start of each call that they are speaking with an AI assistant. Call recordings and transcripts are delivered to the subscribing attorney and stored securely by Presently.

Consent: Attorneys subscribing to Presently consent to the recording and transcription of calls received through their Presently-configured number. Presently's opening disclosure to callers satisfies applicable one-party and two-party consent requirements in New York, New Jersey, and Connecticut. Attorneys operating in other jurisdictions are responsible for ensuring compliance with local recording consent laws.

5. How We Share Information

We do not sell personal information. We share information only as follows:

  • With the subscribing attorney: Call transcripts, summaries, and caller contact details are delivered directly to the attorney whose number received the call
  • Service providers: Twilio (voice infrastructure), Anthropic (AI processing), Supabase (data storage), Stripe (payments), and Resend (email) — each bound by data processing agreements
  • Legal compliance: When required by law, court order, or to protect the rights and safety of our users
  • Eterna Legacy: Attorneys may gift complimentary Eterna Legacy vault accounts to their clients. Data shared with Eterna Legacy is governed by Eterna Legacy's separate privacy policy

6. Data Retention

Call transcripts and session records are retained for the duration of the attorney's active subscription plus 12 months. Upon account cancellation, attorneys may request deletion of their data and associated call records within 30 days. Anonymized, aggregated data may be retained indefinitely for service improvement purposes.

7. Security

We implement industry-standard security measures including encrypted data transmission (TLS), encrypted storage, access controls, and regular security reviews. No system is completely secure; we encourage attorneys to treat call transcripts with the same care as other confidential client communications.

8. Your Rights

Attorneys and their callers may request access to, correction of, or deletion of personal data by contacting us. California residents have additional rights under the CCPA, including the right to know, delete, and opt out of sale (we do not sell data). To exercise any rights, contact demo@presently.legal.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated to attorney subscribers via email at least 14 days before taking effect. Continued use of Presently after the effective date constitutes acceptance of the updated policy.
